These Terms of Service ("Terms") govern access to and use of the Provident Jaxium platform, website, and any associated analytical tools (collectively, the "Service"). This is a general draft template and should be reviewed by qualified legal counsel before publication or reliance, as it does not account for jurisdiction-specific requirements.

1. Acceptance of Terms

By accessing or using the Provident Jaxium Service, you confirm that you have read, understood, and agree to be bound by these Terms and any policies referenced herein, including our Privacy Policy. If you do not agree with any part of these Terms, you must not use the Service.

These Terms apply to all visitors, registered users, and any other persons who access the Service, regardless of the device or method used to do so.

2. Eligibility

You must be at least eighteen (18) years of age and possess the legal capacity to enter into binding agreements to use the Service. By using the Service, you represent and warrant that you meet these eligibility requirements.

Provident Jaxium reserves the right to refuse or suspend access to the Service for any individual or entity that fails to meet these criteria.

3. Nature of the Service

Provident Jaxium provides AI-assisted data analysis and decision-optimisation tools intended for informational and illustrative purposes only. Outputs, models, projections, and any related content generated through the Service do not constitute financial, legal, tax, or investment advice, and should not be relied upon as such.

You are solely responsible for evaluating the accuracy, completeness, and applicability of any output before acting upon it, and for seeking independent professional advice where appropriate.

4. Account Registration

Certain features of the Service may require you to create an account. You agree to provide accurate, current, and complete information during registration and to keep such information up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

Provident Jaxium is not liable for any loss or damage arising from your failure to safeguard your account credentials.

5. Acceptable Use

You agree not to misuse the Service. Prohibited activities include, without limitation: attempting unauthorised access to systems or data, reverse engineering any part of the Service, uploading unlawful or malicious content, interfering with the normal operation of the Service, or using the Service in a manner that could harm Provident Jaxium or third parties.

Provident Jaxium reserves the right to suspend or terminate access for any user found to be in breach of this section, at its sole discretion.

6. Intellectual Property

All content, software, design elements, trademarks, and other intellectual property associated with the Service are owned by or licensed to Provident Jaxium. No rights are granted to you other than the limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms.

You may not copy, modify, distribute, sell, or lease any part of the Service without prior written consent from Provident Jaxium.

7. Fees and Payment

Where the Service includes paid features, applicable fees will be disclosed prior to purchase. All fees are exclusive of applicable taxes unless stated otherwise. Provident Jaxium reserves the right to modify pricing at any time, with reasonable notice provided to existing subscribers where required.

Failure to make timely payment may result in suspension or termination of access to paid features of the Service.

8. Disclaimers

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

Provident Jaxium does not warrant that the Service will be uninterrupted, error-free, or that any analytical output will be accurate, complete, or suitable for your specific circumstances.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Provident Jaxium and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from or related to your use of, or inability to use, the Service.

Nothing in these Terms shall exclude or limit liability that cannot lawfully be excluded or limited under applicable law.

10. Indemnification

You agree to indemnify and hold harmless Provident Jaxium, its affiliates, and their respective officers and employees from any claims, damages, losses, or expenses arising out of your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

11. Termination

Provident Jaxium may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice, including for breach of these Terms. Upon termination, your right to use the Service will cease immediately, and any provisions that by their nature should survive termination will continue to apply.

12. Changes to the Service and Terms

Provident Jaxium reserves the right to modify, suspend, or discontinue the Service, in whole or in part, at any time without liability. We may also revise these Terms periodically; any changes will be effective upon posting the updated Terms on this page. Continued use of the Service following any such changes constitutes acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws applicable in the jurisdiction in which Provident Jaxium is established, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts in that jurisdiction, unless otherwise required by applicable law.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect, and the invalid or unenforceable provision shall be deemed modified to the minimum extent necessary to make it enforceable.
